ADR Is The Solution To Environmental Crimes Including Galamsey- SC Nominee Justice Barbara Frances.
Supreme Court Justice nominee Barbara Frances Ackah-Yensu has disclosed to the Appointments Committee in Parliament that applying Alternative Dispute Resolution, (ADR) can be a possible solution for combating environmental crimes including galamsey.
The Supreme Court nominee made the suggestion when she appeared before the Appointment Committee in Parliament vetting. whiles answering questions from Minority Leader Haruna Iddrisu on the galamsey menace.

When asked the role ADR will play specifically in dealing with galamsey cases, nominee Justice Barbara Frances said:”ADR will come between the communities and the perpetrators if they are made to sit together and have a conversation.”
She opined that the current ADR laws must be amended to that effect
“Speaking as a Judicial Officer, we will determine if any case comes before us on the harmful nature of galamsey, we’ll look at the particular circumstances of each case and apply the law and make a determination. But as a proponent of ADR, I think that a section of environmental matters in the ADR Act, probably will have to be looked at again so that we can try applying ADR mechanisms in resolving galamsey”, she added.
Four persons were nominated by the President for appointment as Supreme Court Judges in July 2022.
The Justices to be considered are Justice Barbara Frances Ackah-Yensu, Justice of the Court of Appeal; Mr. Justice George Kingsley Koomson, Justice of the Court of Appeal; Mr. Justice Samuel Kwame Adibu Asiedu, Justice of the Court of Appeal; and Mr. Justice Ernest Yao Gaewu, Justice of the High Court.
The President made these nominations to fill up expected vacancies at the Apex Court of the Land.
