The Deputy Attorney General, Dr Justice Srem Sai, says suspended Chief Justice Gertrude Torkornoo, has filed a case against the Republic of Ghana at the ECOWAS Community Court of Justice in Abuja, Nigeria.
In a post shared on X (formerly Twitter), Dr Srem Sai revealed that the case was filed on 4th July, 2025 and centres on allegations of human rights violations relating to her suspension and the ongoing proceedings to remove her from office.
According to the Deputy Attorney General, the Chief Justice has raised similar claims in the ECOWAS Court to those already under consideration before Ghana’s Supreme Court and High Court.
According to the post, the CJ is contending that per her suspension, she has effectively been removed from office without a final judicial determination, as she is unable to carry out her constitutionally mandated duties.

“Essentially, Her Ladyship argues that by her suspension, she ‘has effectively been removed from her official capacity without a final determination, impairing her right to function and serve in a position she was constitutionally appointed to,’” Dr Srem Sai stated.
President John Dramani Mahama, in consultation with the Council of State, after reviewing three petitions alleging “stated misbehaviour,” determined that a prima facie case existed and suspended Chief Justice Torkornoo.
A five-member inquiry committee was appointed, led by Supreme Court Justice Gabriel Pwamang, which also included Supreme Court judge Justice Samuel Kwame Adibu‑Asiedu; ex-Auditor General Daniel Yao Domelevo; Major Flora Bazaanura Dalugo from the Ghana Armed Forces (GAF); and Professor James Sefah Dzisah, an academic.
CJ Torkornoo has consistently denied any wrongdoing to warrant the current process, contending the claims against her were either previously dismissed or lacked legal merit under Article 146.
She petitioned the Supreme Court on 21st May for an interlocutory injunction to suspend the inquiry and challenge the appointment of specific committee members for alleged bias.
