The Special Prosecutor, Kissi Agyebeng, has criticised former Finance Minister Ken Ofori-Atta for failing to promptly notify his office of significant changes in his medical condition.

He accused him of deliberately withholding key updates that could have facilitated the rescheduling of his appearance before investigators.

At a press briefing in Accra on Monday, June 2, the Special Prosecutor said that although Mr. Ofori-Atta’s lawyers wrote to the Office on May 28, 2025, notifying them of a cancer diagnosis and a scheduled surgery on June 13, 2025, the OSP had long expected timely communication regarding any changes in his treatment plan.

According to Mr Agyebeng, earlier correspondence from Mr Ofori-Atta’s lawyers in February 2025 had indicated that surgery was scheduled for 20 or 21 March.

As such, when that procedure did not occur, Mr Ofori-Atta had a responsibility to inform the OSP immediately.

“Mr. Ofori-Atta has known, at least since 21 March 2025, that no surgical procedure was to be performed on him in March. Yet, he purposively sat by indolently and chose not to inform the OSP of such fundamental changes in his circumstances,” the Special Prosecutor said.

Instead, he noted, Mr Ofori-Atta waited until just six days before his scheduled appearance on June 2, 2025, to offer a video-recorded interview and suggest that the OSP view his biopsy report, an offer Mr Agyebeng viewed as an attempt to “spring a surprise” on the investigative body.

The OSP has since rejected the virtual interview option, re-declared the former minister a wanted man, and begun processes to place him back on Interpol’s Red Notice list.

He insists that all suspects, regardless of title or condition, must appear in person to provide their caution statements.
