The Mohinani Group, owners of Polytanks Ghana Limited, has petitioned the Inspector General of Police (IGP), Dr. George Akuffo Dampare, over what it describes as the unlawful occupation of its leased premises by armed police officers despite a valid court order suspending an earlier execution.

In a formal petition addressed to the IGP, the company expressed grave concern over the refusal of the Greater Accra Regional Police Command to enforce a ruling by the Commercial Division of the Accra High Court.

The ruling, granted on January 31, 2025, ordered the suspension of the execution of a Certificate of Possession issued to HODA Holdings.

According to the Mohinani Group, on January 28, 2025, court bailiffs, accompanied by armed police officers, forcibly took possession of the West African Packaging and Printing Limited (WAPP) premises. This action, the petition states, was carried out despite the existence of an 11-year Joint Collaboration Agreement signed in 2021 between Mohinani Group and HODA Holdings.

“The forced closure of our premises has resulted in daily financial losses exceeding GHS 1 million, the displacement of 150 direct workers, and a potential loss of 3,000 indirect jobs,” the petition pointed out.

“Additionally, we are unable to fulfil our contractual obligations to major clients, including Unilever, Fan Milk, Nestlé, GB Foods, and Voltic.”

Despite the court’s suspension order, which was forwarded by the Director General of Legal and Prosecutions, DCOP Benjamin Osei Addae, to the Regional Commander on February 6, 2025, the police have failed to comply.

The Mohinani Group asserts that armed personnel remain stationed at the premises, preventing them from resuming operations.

“We have made numerous attempts to engage both HODA Holdings and the police authorities in an effort to resolve this matter amicably, but all efforts have proved futile,” the company stated. “This non-compliance not only undermines judicial authority but also threatens significant economic damage to Ghana’s manufacturing sector.”

The petition signed by the Executive Director of the Mohinani Group, urges the IGP to take immediate action to:

  1. Direct the Greater Accra Regional Commander to comply with the court’s suspension order.
  2. Withdraw all armed individuals from the WAPP premises.
  3. Facilitate Mohinani Group’s lawful re-entry to resume operations.
  4. Investigate the circumstances surrounding the non-compliance with a valid court order.

Mohinani Group reiterated its commitment to Ghana’s industrial development, citing an investment of over US$3 million in WAPP since 2021.

“We trust in your commitment to upholding the rule of law and protecting lawful business operations,” the petition said, calling for swift intervention from the highest levels of law enforcement.

As of press time, neither the Ghana Police Service nor HODA Holdings had publicly responded to the petition.
