Acting Managing Director of Goldbod, Sammy Gyamfi, has stated that if President John Dramani Mahama had not suspended Chief Justice Gertrude Sackey Torkornoo, he could have faced impeachment.
Mr. Gyamfi explained that the decision was in accordance with the Constitution, stressing that President Mahama is a leader who holds no personal bitterness.
“President Mahama is a man without bitterness. He doesn’t hold grudges against anyone, including Chief Justice Gertrude Sackey Torkornoo. The decision was not driven by personal issues,” he said in an interview on Asempa FM’s Ekosii Sen show.
According to Mr. Gyamfi, the President’s actions align with the constitutional requirements outlined in Article 146, which governs the suspension of a sitting Chief Justice.
He clarified that Mahama did not act alone but sought advice from the Council of State, leading to the formation of a committee to assess the matter before taking any steps.
“Mahama is not acting out of vindictiveness. He is simply following the Constitution. As President, he swore an oath to protect the Constitution of Ghana. He cannot arbitrarily sack the Chief Justice; he must follow the procedures outlined in the law,” he added.
The National Communications Officer for the NDC also mentioned that this situation is not unprecedented, pointing out that former President Akufo-Addo had faced multiple petitions for the removal of a Chief Justice, some of which were ignored, including.
“We have precedents that define how these matters should be handled,” he added.
The Acting Managing Director stated that Mahama’s primary focus is the welfare of the people and the integrity of the Constitution, rather than any personal vendetta.
The suspension, announced on April 22, follows the establishment of a committee to investigate multiple petitions filed against the top judicial official.
The move complied with constitutional provisions and followed consultations with the Council of State.
