Kpandai Re-run: Our participation uncertain until legal processes exhausted – Haruna Mohammed

The Deputy General Secretary of the New Patriotic Party (NPP), Haruna Mohammed, has stated that the party is not yet in a position to confirm whether it will participate in a forthcoming parliamentary by-election, stressing the need to first exhaust all legal avenues.

Speaking on Joy FM’s News Night, Haruna Mohammed said, “So as a party, until we exhaust all the legal processes that we have put through, we are unable to say whether we are going for any election,” he said.

His comments come following the action of the Clerk to Parliament, Ebenezer Ahumah Djietror, who on 4th December, 2025, formally notified the Electoral Commission (EC) of a parliamentary vacancy.

The notification compels the EC to organise a by-election within 90 days, as stipulated under Article 112(5) of the 1992 Constitution.

The Minority Caucus has strongly objected to the Clerk’s letter, demanding its immediate withdrawal.

They argue that the action is unlawful, procedurally defective, and inconsistent with ongoing legal proceedings related to the matter. The reaction is intensified by the highly contested composition of the current Parliament.

Haruna Mohammed explained that the NPP has decided to pursue the matter through the courts to determine the validity of the Tamale judgement, which the party describes as “a miscarriage of justice” and “not grounded on law.”

He added that the petition before the Tamale court was filed out of time, prompting the party to initiate processes to halt the ruling.

“We have done the stay of execution, we have argued our case yesterday in court, and there will be a judgement on that on the 18th. We’ve also sent a judicial review to the Supreme Court, which will also be heard on Tuesday,” he said.
