The Acting Managing Director of the GoldBod, Sammy Gyamfi has stated that Ghana’s justice system could have faced serious challenges had President John Mahama not suspended the Chief Justice Mrs. Gertrude Torkornoo while she is being probed for alleged misconduct in the face of petitions seeking her removal from office.

Sammy Gyamfi argued that the suspension was essential to prevent potential disruption in the administration of justice.

Speaking on the Super Morning Show on Joy FM on April 24, Mr Gyamfi stressed the importance of the president’s decision, which followed allegations made against the Chief Justice and the subsequent investigation initiated by the president.

Mr Gyamfi explained that the Chief Justice plays a critical role in overseeing the entire judiciary and the administration of justice in the country.

Given the gravity of the ongoing investigation, he believes it would have been impossible for her to effectively carry out her responsibilities while defending herself before the investigative committee.

“No one can convince me that she could give the necessary attention to her duties while also defending herself in a quasi-judicial process,” Mr Gyamfi said.

“This investigation is akin to a trial, and as Chief Justice, she would have been distracted from her primary responsibilities, which are vital to the smooth operation of the justice system,” he added.

He argued that the administration of justice is far too important to be left in the hands of someone undergoing an investigation.

The Chief Justice, he said, would have struggled to focus on her important duties while dealing with the investigation under Article 146 of the Constitution.

“She wouldn’t have the peace of mind necessary to make crucial decisions, and this could have undermined public trust in the judiciary,” he added.

Mr Gyamfi also pointed out the added burden the Chief Justice would have faced, having to divide her attention between her official duties and preparing her defence.

He believes this would have been unfair to both her and the public, who rely on a functioning justice system.

The GoldBod A. CEO concluded that the President’s decision to suspend the Chief Justice was both sensible and necessary, explaining that by temporarily stepping aside, the Chief Justice would have had the time and space needed to fully focus on her defence without the added pressure of her administrative responsibilities.

“The suspension ensures that the judiciary continues to operate smoothly without disruption,” Mr Gyamfi said.

“It also gives the Chief Justice the opportunity to address the allegations against her properly, which is in the best interest of justice,” he stated.

Mr Gyamfi further explained that the Chief Justice herself would likely be grateful for the suspension, as it would allow her to concentrate on defending herself without the distraction of her official duties.

“I think she herself will be very grateful to the president for suspending her to give her the opportunity to fully focus on defending the petitions against.”He said.

“This will provides her with the time and resources to focus entirely on the investigation, preserving her integrity and allowing her to respond effectively to the allegations.”He concluded.
