The Office of the Special Prosecutor (OSP) has expressed scepticism regarding the health status of Mr Ken Ofori-Atta, the former Minister of Finance, who has issued a letter indicating he is unwell and is being managed in the USA.

Lawyers of the former Finance Minister have written to inform the OSP about his condition and why he is absent from the jurisdiction.

Unconvinced, the Special Prosecutor, Kissi Agyebeng has declared him a fugitive in connection with multiple cases under investigation, including the construction of the National Cathedral and the Ghana Revenue Authority (GRA) – Strategic Mobilisation Ghana Ltd (SML) deal.

During a press briefing on Wednesday, 12th February, Kissi Agyebeng asserted that an earlier letter by Ken Ofori-Atta indicating he would be away indefinitely demonstrates he had no intention of returning to Ghana anytime soon.

“Investigations will continue as prescribed by law. The OSP’s intelligence, which cannot be disclosed at this time to avoid compromising the investigation, strongly suggests that Mr Ofori-Atta’s alleged imminent peril upon returning is unfounded,” he stated.

Addressing the media, Mr Agyebeng reiterated that the letter provided through Mr Ofori-Atta’s legal representatives does not substantiate claims of incapacitation or severe illness.

“The purported medical letter transmitted through his lawyers to the OSP does not establish or demonstrate that he is incapable of returning. The OSP remains unconvinced that the letter constitutes a valid medical report proving that Mr Ofori-Atta is so ill or physically incapacitated that returning to Ghana would imperil his life,” he stated.

Furthermore, Mr Agyebeng maintained that no serious law enforcement agency, including the OSP, would accept the medical letter as justification for Mr Ofori-Atta’s continued absence.

“No serious law enforcement agency, and certainly not the OSP, will be convinced that the purported medical letter prevents it from demanding Mr Ofori-Atta’s physical appearance before it under the described circumstances,” he added.

He asked Ken Ofori-Atta to submit himself to assist in the investigations or be compelled to do so.
