Merton & Everett LLP has initiated a new round of class action lawsuits against SuCasa Properties Ltd, accusing the embattled real estate firm of fraudulent misrepresentation, breach of contract, and unfair competition.

The legal action, filed on behalf of 47 affected customers, seeks to recover substantial financial losses linked to SuCasa’s failure to deliver on its contractual obligations.

According to Merton & Everett LLP, SuCasa systematically misled homebuyers and investors by falsely advertising unrealistic construction timelines, promising high-quality housing, and guaranteeing secure land ownership.

Many plaintiffs were induced to enter into sales and purchase agreements under these assurances but later discovered that the company lacked the capacity or intent to fulfill them.

Despite making full or significant payments, numerous plaintiffs claim they have yet to receive their properties, while others say they were handed substandard or defective units.

The lawsuits seek full refunds and compensation totaling over $2 million, GHS 5.7 million, €5,016.66, and £9,432.19 for undelivered or defective properties.

Plaintiffs are also demanding legal declarations against SuCasa for breaching contracts and misrepresenting construction quality, timelines, and ownership rights.

Additionally, the suits seek damages and legal costs, including compensation for financial losses, alternative housing expenses, legal fees, and emotional distress. Interest on unlawfully withheld funds is also being claimed.

The lawyers argue that SuCasa engaged in unfair competition and unjust enrichment, violating Ghana’s Protection Against Unfair Competition Act, 2000 (Act 589).

They are also pushing for orders compelling the company to either complete pending constructions or issue valid property title deeds to affected customers.

The firm noted that the lawsuits highlight broader concerns about SuCasa’s financial instability, as the company is currently under court-ordered administration. Merton & Everett LLP also called on other affected customers to come forward.
