Lawyer for former Finance Minister Ken Ofori-Atta, Mr Frank Davies, has criticised the Office of the Special Prosecutor (OSP) for what he describes as an inappropriate and unauthorised disclosure of his client’s medical condition.

This follows a media briefing by the Special Prosecutor, Kissi Agyebeng, on Monday, 2 June 2025, during which he announced that Mr Ofori-Atta had again failed to honour a summons by the OSP for questioning. According to Mr Agyebeng, the former Finance Minister’s lawyers had attributed his absence to a cancer diagnosis.

However, in an interview on Top Story on Joy FM, Mr Davies condemned the OSP’s comments, accusing Mr Agyebeng of lacking discretion and decorum. “I didn’t think he was going to disclose this,” Mr Davies said. “But if he has gone ahead to say that Mr Ofori-Atta has been diagnosed with a cancer illness, then I must say, he does not appreciate the sensitivity of the matter.
The Special Prosecutor must be very careful. Being appointed to public office does not give one the liberty to speak off the cuff or make loose statements.”

Mr Davies also stated that the legal team had duly submitted a formal medical report to the OSP, signed by licensed medical professionals, affirming Mr Ofori-Atta’s current health challenges and confirming his inability to attend the scheduled meeting.

“We sent a report posted by doctors to him, and the conclusion of the doctors was that he was unable to make the appointment,” Mr Davies explained.

The OSP had earlier cast doubt on the authenticity of the health excuse, suggesting it might be a calculated move to delay or avoid accountability. Mr Davies refuted that notion, insisting that the medical report speaks for itself and that the legal team has acted in full compliance with due process.
