Court judgment puts hundreds of East Airport homeowners in Tesa on notice to regularise tenancy

Hundreds of residents in the upscale Tesa (East Airport) area of Accra have been formally notified that the land their homes are built on legally belongs to a different family, compelling them to sign new tenancy agreements or face potential eviction.

This development follows a High Court judgment that declared the Kofi Anum Family as the rightful owners of the 123-acre land, parts of which were developed and sold by real estate giant, Regimanuel Gray Ltd, while the ownership dispute was still in court.

In a “Notice of Judgment” letter dated November 14, 2025, and sighted by MyJoyOnline, the solicitors for the Kofi Anum Family, Azizbamba & Associates, have given all affected homeowners 30 days to “attorn tenancy” – a legal term meaning to formally accept the family as their new landlord.

The letter states, “Our Client is… open to practical and fair solutions that regularise the position of genuine homeowners.”

However, it also carries a stern warning that failure to comply will lead to an application for a “Writ of Possession” against non-cooperating occupiers, a legal step that can force them out of their properties.

The court found that even though Regimanuel Gray Ltd (the 1st Defendant) sold plots and encouraged development, it did not have a valid title to the land at the time of the sales. The judgment leverages the legal principle of *lis pendens*, which means that anyone who buys a property while it is subject to ongoing litigation does so at their own risk and is bound by the court’s final decision.

While Regimanuel Gray Ltd has filed an appeal, the lawyers’ letter emphasises that the appeal does not challenge the core finding that the Kofi Anum Family are the true owner.

Homeowners, many of whom invested their life savings into their properties, are now in a precarious position. They have been asked to submit documents, including their sale agreements and building permits, within 14 days to assist in mapping the estate.

The residents now have two main options: either enter into a new lease directly with the Kofi Anum Family, which would involve paying ground rent to them, or voluntarily vacate their homes within the 30-day window.

The lawyers have also written to the Regimanuel Gray East Airport Homeowners Association, urging it to cooperate and circulate the notice to all affected residents in estates like Silver Bell, Golden Gates, and parts of Platinum Gates.
