Mr. Martin Kpebu

Private legal practitioner, Martin Kpebu has asked Attorney General Godfred Yeboah Dame to admit that he erred in his opinion on the former Environment Minister, Prof Frimpong Boateng’s report on illegal mining.

Speaking in an interview on Joy FM’s Top Story on Wednesday, October 11, Mr Kpebu reiterated that a thorough investigation was not done on the report.

He therefore urged the Attorney General to reserve his advice on the matter.

“Mr Dame shouldn’t take us for fools. No, we are all at the Bar, he is not superhuman, he should accept that he has made a mistake. He was busy and didn’t supervise or if it was intentional, too bad. He should just go back and do the right thing,” he said.

Frimpong-Boateng’s galamsey report empty; no evidence to aid prosecution – AG to CID

This comes after the Attorney General in his advice to the Criminal Investigation Department (CID) concluded that Prof Frimpong Boateng’s allegations in his report on illegal mining activities in the country are empty and do not have evidence to prosecute the persons named to have committed mining and other offences.

The Attorney-General has therefore asked the police to discharge persons mentioned in the report except those still under investigation.

But this decision was criticised by Mr Kpebu who described it as incomplete and a whitewash.

This, he explained is because the Attorney General’s report did not talk about investigations in the forest where the illegal mining took place, therefore they ought to move to the grounds to ascertain the facts.

In an interview on Joy FM’s Middaynews on Wednesday, Mr Yeboah Dame asked his critics to make use of the Right to Information (RTI) law if they want to know the processes involved with the investigation and updates on the matter.

Responding to the Attorney General’s advice, Mr Kpebu called it a dereliction of duty, saying it amounted to “abrogating and reprobating.”

According to him, in every legal option, you list every detail involved in the investigation.

“Do not use freedom of information to tackle this thing. The AG’s opinion will not pass muster. He should just withdraw it and do a thorough investigation.”
