Lawyer Beatrice Annan, spokesperson for the John Mahama campaign team, has questioned the constitutional basis for Majority Leader Alexander Kwamena Afenyo-Markin’s recent court petition.

Annan referred to Article 29, Clause 5, and Order 19, Rule 3, Subrule 3 of CI 47, which Afenyo-Markin cited in his legal action. Article 29 states, “In any judicial proceedings in which a disabled person is a party, the legal procedure applied shall take his physical and mental condition into account.”

Annan argued that this provision is irrelevant to the current situation. “Who’s disabled here? Afenyo-Markin, the Speaker of Parliament, or Godfred Dame?” she questioned.

She emphasized that the Article is intended for individuals with mental instability or physical disabilities, asserting that it does not apply to the matter at hand.

This exchange follows Afenyo-Markin’s call for the Speaker of Parliament to adhere to the Supreme Court’s ruling, which has temporarily stayed the Speaker’s decision declaring four parliamentary seats vacant.

The Supreme Court directed that Parliament must recognize the four Members of Parliament (MPs), allowing them to represent their constituencies and perform their official duties.
